Kleinberg, Kay don't meet in court

MARLBORO - Mayor Robert Kleinberg and developer Eddie Kay did not face off in court last week as anticipated.

It was reported in the Oct. 10 issue of the News Transcript that the two men would be in Holmdel municipal court on Oct. 10. It was learned after press time that the hearing would not be held that morning.

A court official in Holmdel said on Oct. 9 that the case is scheduled to be heard in that town's municipal court, but at this time no date for the hearing has been set.

The case stems from an incident that occurred on the afternoon of Sept. 29 on Gordons Corner Road near Vista Drive in Marlboro. The incident involved Kay's removal of a Kleinberg campaign sign that had been placed near the Triangle Ridge housing development.

Kay claims the sign was on property he is responsible for maintaining.

Kleinberg claims the sign was on a municipal easement.

Kay has charged Kleinberg with assault by auto and Kleinberg has charged Kay with assault.

The two men have had a contentious relationship for some time now over issues in Marlboro, including alleged corrupt activities relating to development projects on Kay's part.

Through e-mail correspondence Kay said he believes the matter regarding the mayor's campaign sign will be heard in court sometime in December.

Kleinberg, a Republican, is seeking a second four-year term as Marlboro's mayor. He is being challenged by Democrat Jon Hornik. Election Day is Nov. 6.
